This Privacy Policy applies to:

• Customers and their users who access the Platform.

• Creators who provide services through our creator network.

• People who appear in footage, photographs, or audio produced or processed through the Platform.

• Visitors to www.socreative.com.

We use personal information to:

• Provide, operate, and improve the Platform and Services.

• Process transactions and manage subscriptions.

• Match projects and shoots with suitable Creators, and manage bookings and payments to Creators.

• Communicate with you about your account, projects, assignments, and support requests.

• Send you marketing communications (with your consent where required; see Section 7).

• Analyze usage patterns to improve the Platform experience.

• Detect, prevent, and address fraud, security issues, and technical problems.

• Comply with legal obligations and enforce our Terms of Use and Creator Agreement.

Where the GDPR applies, we rely on the following legal bases: performance of our contract with you, our legitimate interests in operating and improving our business, compliance with legal obligations, and your consent (for example, for marketing and non-essential cookies).

We use artificial intelligence tools to assist with brief analysis, the in-platform assistant, project matching, content recommendations, editing, voiceover, and quality assurance. Content you submit may be processed by our AI model providers to deliver these features.

We do not use your content to train AI models. Where an AI provider offers the option, we configure our accounts so that content we submit is not used to train the provider's models.

We do not make decisions that produce legal or similarly significant effects about you based solely on automated processing. You can contact us to request information about automated processing that affects you.

We do not sell your personal information. We may share your information with:

• Related entities: SoCreative Pte. Ltd. and its related entities, to deliver the Services.

• Creators and customers: project information (briefs, brand assets, locations, feedback) is shared with the SoCreative team members and Creators assigned to a project, and a Creator's name and relevant profile details are shared with the customer they are booked for.

• Service providers: companies that help us operate the Platform, who are contractually bound to protect your data (see Section 5.1).

• Professional advisors: lawyers, accountants, and auditors as necessary for our business operations.

• Law enforcement and regulators: where required by law, regulation, legal process, or enforceable government request.

• Business transfers: in connection with a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such change.

5.1 Service providers

SoCreative is headquartered in Singapore and works with a global network of Creators. Platform data is hosted with cloud providers in the Asia-Pacific region, and your personal information may be transferred to and processed in other countries, including Singapore and countries where our team members, Creators, and service providers are located.

When we transfer personal information outside the country where it was collected, we take steps to ensure it receives a standard of protection comparable to that required under the Singapore Personal Data Protection Act 2012 and other applicable laws. For transfers of personal data from the EEA or UK, we rely on Standard Contractual Clauses approved by the European Commission or on adequacy decisions where available.

We may send you emails about new features, services, promotions, and content we think you'll find useful, with your consent where the law requires it. You can opt out of marketing communications at any time by clicking the unsubscribe link in any marketing email or by contacting us at contact@socreative.com. Opting out of marketing communications does not affect transactional or service-related messages.

We use cookies and similar technologies to operate the Platform, analyze usage, and improve your experience. The types of cookies we use include:

• Essential cookies: required for the Platform to function (e.g., authentication, security). These cannot be disabled.

• Analytics cookies: help us understand how visitors use our website and the Platform (e.g., Google Analytics).

• Functional cookies: remember your preferences and settings.

• Marketing cookies: used to deliver relevant advertising and measure campaign effectiveness.

Where required by law, analytics and marketing cookies are only set after you accept them through our cookie consent banner. You can change your preferences at any time through the banner or your browser settings. Disabling certain cookies may affect the functionality of the Platform.

We retain personal information only for as long as we need it for the purposes described in this policy. Specifically:

• Account information: retained for the duration of your subscription and for 12 months after account closure, unless a longer period is required by law.

• Project content and files: retained on the Platform while your subscription is active. Ninety (90) days after your subscription ends, all content and files are permanently deleted and cannot be recovered. Content may be deleted sooner if a plan is canceled for non-payment, as described in our Terms of Use.

• Creator information: retained while you are part of our creator network and for 12 months after you leave, except payment and tax records.

• Billing and payment records: retained for as long as required by tax and accounting laws, generally up to 7 years.

• Usage and analytics data: retained in aggregated, de-identified form for product improvement purposes.

We implement reasonable technical, administrative, and organizational measures to protect personal information from unauthorized access, use, disclosure, alteration, or destruction, including encryption of data in transit and at rest and role-based access controls. However, no method of electronic storage or transmission is 100% secure, and we cannot guarantee absolute security.

If a data breach occurs that is likely to result in significant harm to affected individuals, or that affects 500 or more individuals, we will notify the Personal Data Protection Commission of Singapore as required under the Personal Data Protection Act 2012. Where a breach is likely to result in significant harm, we will also notify the affected individuals. Where applicable, we will also notify other data protection authorities as required by local law, including relevant EU or UK supervisory authorities within 72 hours as required by the GDPR.

The Platform is not directed at individuals under the age of 18, and we do not knowingly collect personal information from children as users. Where a minor appears in content produced for a customer, the customer is responsible for obtaining consent from a parent or guardian. If we become aware that we have collected personal information from a child without appropriate consent, we will take steps to delete it promptly.

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. We will notify you of material changes via email or in-platform notification. The "Last modified" date at the top of this policy indicates when it was last updated.
